Go to the doctor and get tested for cerebral palsy. This makes the nystagmus evidence go away.

Have a lawyer subpeona the source code from the company called intoxylyzer. Its a trade secret so they won't give it up. Throws out the breathalyzer. This might not work anymore, but every cop station uses a machine made by that company.

Then get a lawyer to review the DUI laws wording. If it says operating the vehicle on a public roadway only you win. The law has to list all official names for roads in the cops jurisdiction you got stopped. Something like "operating a motor vehicle on a public lane, place, court, road, parkway, highway, avenue, etc." If it doesn't say all those things for some legal reason the police don't have jurisdiction.

You probably have a DMV type case also. That's all about timing. Find out the cop's schedule and try to serve him on the days he's off.
