Friendly PSA: Never consent to a search!

This is a friendly Public Service Announcement to fellow RVFers, to not consent to a search.

Cops will most likely charge you with anything that is found, even if it's not yours. It was in your car so you're responsible. What if the coke package they found looks old? Some don't care and will charge you for it. Even if you don't have anything, tell them know because you never know who was in your car and dropped something.

Cousin Jimmy left a crack pipe 2 months ago? You're getting charged.

I'll be honest, this happened to me an hour ago. I was going 5 over the limit and got pulled over by state police. The cop wanted to search me because my vehicle looked suspicious, and by that.....window tint. Limo on the rear side, tinted on the front sides, and light on the front. It was all within regulations he couldn't really see behind. I said....sure, why the fuck not! I don't do drugs nor do my parents so whatever, they won't find anything. The car we got was bought used and the cops noticed something wrong with the panels. They brought a K9 from Dallas PD, it indicated there was something in the gas tank. These fuckers started, especially the Dallas Narcotics Officer (DNO), accusing me of transporting dope and doing drugs. I told them no, and they kept saying yes and to admit it. I kept telling them no. The DNO told me knew I was lying about not doing drugs because his dog doesn't lie.....I don't do drugs.

In the end, I got detained and rode with them to a car shop so they could inspect it. This was after they opened every compartment and threw everything outside......they fucking searched 3 times in the shop! Then they took the tires, I started laughing and told them they're just wasting their time. They kept asking to just confess, which I didn't and called my family to let them know what's up. The senior cop didn't let me but the rookie convinced him to and I called them. After taking the rear apart, the dog searched again and scratched the rear and gas tank area. So now they had to take the gas tank off and search it, they did again and again. They found nothing and let me go after being detained for 5 hours. Now I'll be late to Midland. The fuckers instead of giving a report like I asked just gave me a warning with no search being indicated. I got a warning instead of a ticket because "I was cooperative".

Here's the thing, the car is used. My family does not associate with drugs, neither do I as I got arrested for it as a kid and don't want more problems. But one of the previous owners might have stuffed the car with drugs and we would have not known. The cops kept asking me if I've been to Mexico since some of the body parts look altered. I'm kinda weary of used cars now.

The rookie cop was badass, he told me to relax and let me use my phone to call my family along with going to the restroom alone. We talked about broads (I was coming from fucking a new broad, going to my parents, then heading to Midland), game, and police life. I think he was cool since he has 2 years in and is 26. He was talking to another cop about finding a brick of weed inside a car last week but not charging the driver as the packaging looked old and it was before the driver had the car.

The senior cop was a complete asshole, he straight up told me "I don't care if it's yours or not, whatever I find I'm charging you for it!". He wouldn't let me go to the restroom nor call to let people know I was okay. The asshole kept asking me how I bought clothing and alcohol if I didn't have a job, why I kept going to midland, why i only filled 1/2 a tank and a full tank at different times. He also wanted to know why I wanted to work in the oilfield when I have a degree. In the end, the more I was being cooperative, the more he was becoming an asshole.

The other trooper was okay, in between the rookie and the senior officer.

The dude from Dallas Narcotics, total asshole. Kept telling me I was lying and he knew my mom or I smoked pot. His fucking dog did this!

It's an old car, from 2003, but I'll rather scratch it than some dog.

I could have saved myself time and a major headache if I had not consented to a search.

Don't fall for the cop's pressure trap of "if you got nothing hide, you got nothing to fear"...because they will charge you for anything.

Edit: As soon as I was not detained anymore, took my phone out, and started taking pictures of them and my car's damage; they rapidly printed out my warning and handed it over to me to sign and told me to go home. I admit, it was the worst bang ROI ever.

The rookie was cool, he said that most cops will treat you how you treat them. Since I was being cool with him, he was cool with me. Dude took me in the front sit, didn't cuff me, and gave me the option to chose the radio station. I asked him if I could see my car get searched? He said okay. Can I pee and make a phone call? Sure, I could go alone. He gave me some Cheetos and a Monster.

But the rest? Assholes.

On the other hand, one of the dudes working in the tow-truck shop asked me questions on how to get a job in midland. I found that funny.

What was supposed to be a 10 minute stop turned into a 5 hour ordeal.

Sory to hear that happenned. Great advice never consent, cops are not your friends they will say stupid shit like just tell us where it is we'll let you go...lol yeah right. Cops are not your friends and in the grand scheme of things really have no power to lessen charges or anything despite what they say. If htey are asking to search it's because they don't have probably cause to search without asking.

Now keep in mind if a cop wants to search he can and he will, all he has to say is he smelled some weed or call a dog and as we all know dogs are trianed to "hit" on certain commands the officer may give such as tapping his foot, scratching his nose, etc so if they wanna look in your car they will but if you don't consent it gives you more ammo down the road to get evidence thrown out.

There is one situation in which it may be okay to search or not search so much as handover whatever you have. If you have a cool cop and you get a good read on him and he says look if you just got a little bit of weed give it to me and I'll let you go or write you a summons instead of taking you to jail, use your best judgement but sometimes if you save them the hassle of calling out dogs they'll go easy on you but most cops are assholes so unless you get a good read on the guy and feel he's being honest don't do this. Normally city cops you don't mess with they are assholes and have nothing better to do, normally at least in my area Sherrifs and State Troopers aren't looking to bust you over a half gram of weed or an open beer and won't fuck with you too much.

Any possibility of getting the cops to pay for your car?

Lastly, don't have tints, don't have a GPS or something in your front window, cops will say it gets in the way of your view and can pull you over for it. Don't do anything with your car to stick out or to give them a reason to pull you over. I'm like a leaparcon, I always carry a little pot with me so these things are important to me.

I think the ideal safeguard would be an automatic 'video record and public upload app' on your phone. The moment police pull you over, you start it and inform them 'this is being recorded and uploaded to a public website over 3G'. It would be especially powerful if the app displayed a logo of that website, and became well known.

The police would be forced, by their own peril, to abide by the law. The video witness would be infallible, and destroying the phone wouldn't destroy the evidence (which would be available publically).

And then you have every one of your routine traffic stops uploaded so the public can scrutinize them. Not ideal. Instead, just upload them privately and give your family members access in the case of something happening to you.

There's already an app to upload videos publicly OR privately. It's called Bambuser. Check it out. Probably overall the best one out there. Android Link, iOS Link.

If you don't like that one, there's also Cop Recorder (Android Link, iOS Link). If you like Dropbox, try Fi-Vo Film (Android Link, iOS Link). Open Watch stores your geolocation data in addition to audio/video (Android Link).

Dodging cops is an even better idea. Check out Police Scanner 5-0, which gives you police radio feeds (Android Link, iOS Link). Trapster (Android Link, iOS Link), based on user reports, alerts you of nearby enforcement cameras, speed/DUI traps, and road hazards.

Make sure if you're recording that you inform the police officer (depending on your state's laws), as audio recording without consent can get you into a heap of trouble. A police officer CANNOT make a binding demand that you discontinue video or audio recording him. Realize that by refusing to kowtow to police, you are likely going to piss them off, and that you may be harassed more than is typical.

I know about this, folks use car lots or car shops and use cars to transport drugs or money inside hidden panels, fake gas tanks, and inside tires. They would get a spacious car like a camry or accord, stuff it, ship it, then sell it. There was one time a shitty car that would go for 2K was auctioned for 24K, story has it the cops seized the car and local dealers were competing for it to see if it had something inside.

Now I'm somewhat "iffy" to buying used cars, especially in Oak Cliff (hispanic, high crime, cartel presence), as the area has many car lots and it's easy to dump a car and get another one.

If you guys thought that area was scratched badly......the area around the gas door is worse. I took pics while they were there so I'll file for damages.

Another thing I just remembered is....I used to work a trooper who is now in charge a Dallas area. I'll pay him a visit and play some leverage.

This. Just before going to bed I realized they were playing "good cop / bad cop" on me. I didn't have anything in it and kept my story straight. Didn't give them much info, at one point I was the one asking them questions (cop camera, cop radar, recording system).

Should have kept my mouth shut and realized this earlier.

Yup, I failed to maintain my frame. Didn't want to get a ticket and derail my chances of getting a job that requires no traffic tickets.

Actually, I lost frame much earlier when I met that bitch at her apartment and she turned out to be different than her picture. I went in for the hate bang since I drove there already along the toll road.

By the time the popo stopped me, I had no frame [Image: sad.gif]

Edit: my phone only had 2% battery when it was in the car shop (after they towed it from the highway) so recording on it was going to be a 2 minute thing.

I like the idea but there are problems with this. Like getting it in as evidence in court is the biggest one. Not all states are one party when it comes to recording, and I do not think you can record all police officers in every state either.

Even if you got police brutality on tape, it will not help very much. They might get a reprimand at worst. You will still get persecuted for any possible crimes you committed. It will not block any potential evidence against you from being presented in court either. SP5 or anyone else correct me if I am wrong on that.

The best a full camera system might help with, is if they plant dope in your car trying to be sneaky to fuck you up. If the courts reject it, the best you could do in that case is release the tape to your local news muckraker and hope they will show it on the news to create enough public outrage. You still might end up doing some time though, who knows.

The biggest issue I have with these cops is how far can I drive to find a well lit public place instead of driving on a dark and empty road before it becomes evading arrest or something. I have pissed off a couple cops because I drove until I found a gas station that was well lit with people and cameras outside. I just play stupid when they asked why I drove to the gas station instead of the dark highway.

They were probably profiling. I'm surprised though, usually that kind of treatment is reserved for minorities in Denton County where the courts are still run by 'good ol' boys' and cops can get away with almost anything.

Try doing this along large water puddles and curves.

I saw a cop let a lady go because he didn't want to get off on a water puddle next to a busy street.

Curves are dangerous for them as cars can't really see what's ahead of them.

Not sure what county this was, it was on the Dallas/Collin/Denton County border. It was on Bush past Tollway going towards 35. The car shop was in Plano. But yeah, Collin and Denton are straight up Goold Ol' Boys system.

They are public officials but many states and cities are passing laws making it illegal to record police officers under any circumstances. Only a few have made it legal to record them without their consent as they're public employees.

There was a guy who posted his interaction with the cops, the cops had fucked up somehow, it went on the news. Next thing you know....the prosecutor was pressing charges against the guy for recording the cops.

Are you going to going to talk to an attorney?

There are a few things that are troubling:
1) dog scratches to car
2) unreasonable & unusual length of detention & searching (searched 3 times in a shop)

It can't hurt to talk to an attorney just to see if you have a case. Consultations are free.
