Ellen Pao (Reddit CEO) gender discrimination claim falls apart during trial

I think it does depend on state. When I researched this before the federal guidelines put it at above the requirements to be a small business if I remember correctly. If I remember correctly, a small business is defined as a business with less than 500 employees but it also differs based on industry with some definitions in the less than 250 employees and some as less than 100 employees with other at less than 750 or even 1000 employees. So, fields like construction, agriculture, and mining have larger caps with things like retail having lower caps. They also define small businesses by industry based of sales receipts which fluctuate wildly. I know that there are also state laws. I think it my state it is between 45 and 60 employees that the equal representation laws come into effect. However, it also depends on the industry. This is why Hooters and strip clubs don't get sued for not hiring males. Their business model precludes it. Also, it depends on whether or not you are a right to work state and also whether or not there is sufficient diversity in the occupation.

By that it means, from what I understand, that if you are in some niche business where there may only be a small portion of people qualified or licensed to do something, then you may not be found as discriminatory. Think about some of the people who are licensed and certified to fix specialized machinery found in certain types of factories. In some of those cases there may only be a thousand or even less people in the whole world with experience and certification on some specially built machine.

The US corporate and legal structure necessitates signing legal waivers before sex happens. At some companies you have to disclose your relationship status for legal reasons.

I would go a step further in the US and enforce NBA-like legal waivers that have to be signed by women before sex. So be it - if they get fucked, then no perks, no money, no favors are given. Or best yet - don't hire women at all unless you own a strip-joint.

I do wonder what is the maximum number of employees you can employ before you have to hire a woman in the USA. It might depend by state.

Women these days think they can shop for a man like they shop for a purse or a pair of shoes. Sorry ladies. It doesn't work that way.

Women are like sandwiches. All men love sandwiches. That's a given. But sandwiches are only good when they're fresh. Nobody wants a day old sandwich. The bread is all soggy and the meat is spoiled.
