“I put him down as father to get assistance,” she told 7 Action News.
She didn’t realize that would start a paternity case. The state would want to get reimbursement for welfare benefits from the child’s dad.
A process server turned in paperwork to the court saying Carnell had been notified of the paternity hearing. The paperwork said the notification happened at a house in Highland Park. Because on paper he had been given notice, when he didn’t show up at court, he was legally listed as father by default.
What kind of a mockery of law is this shit? There is no plaintiff, there is no defendant, yet the judge takes the matter into her own hand and ''legally list him as father by default'' what the fuck is that even supposed to mean? The woman did not sue for paternity. The man did not get served.
Basically, a judge looked at a welfare application form (?), saw the name of a man as father, and without the mother's request, without notifying the man, without due process, ruled that he is the father and must pay child support. I'm having hard time believing what I'm reading. Is this what the law has been reduced to in US?
