The FCC has done good things similar to this before. During the 700 MHz C Block spectrum auction (which Verizon ultimately won and uses for LTE) rules were put in allowing device portability and kept them from throttling users. Hence why the few unlimited plans left on Verizon go for $1500 on eBay.
