I wonder if this is grounds for a sex discrimination lawsuit. If a company offers benefits that can only be used by one sex, does that constitute discrimination? Would it pass muster if employee spouses can use the benefit as well? That would still leave single men, gay male couples and those who prefer to remain childless uncovered.
Also, to file such a lawsuit, you'd have to show damages - you'd have to be an employee. There may not be an employee willing to file such a suit.
In most industries, you could simply raise wages instead of offering the benefit, and capture a more male or nonreproductive workforce. That won't happen in modern Silicon Valley, because all the big tech firms are desperate to hire more women.
