Incredibly easy. You just push a button for a photo, push and hold for video.

I imagine if I were at a girls place, I would use it like I said when I quoted the guy above - I have evidence of the date, I'd get evidence of consensual sex, and I'd switch it on right before I leave.

As a disclaimer, I'm not a lawyer, nor have I ever been anywhere close to being convicted, so who knows how any of this would go down in court. I'd always say the best defence against the rape accusation is to screen out drama girls in the first place.
