This is bullshit, and there should be no way a court invalidates that agreement. The girl took the money to give up her right to sue. If a court does invalidate it then she better be ready to pay back the money.
But I think the likely next step in the Metoo witch hunt is that lawmakers will make a law declaring settlement agreements concerning sexual encounters be invalidated if the girl claims rape or that sexual assault occurred during the encounter.
And I think that goes for NDAs too, especially after Trump and Weinstein. I could see state's enacting laws that NDA's concerning sexual encounters be prohibited as illegal contracts, or invalidate the agreement if sexual assault occurred, or even limit the number of years that these agreements can be enforceable.
I wouldn't be surprised if it happens. Look at how prenups are being thrown out left and right by judges nowadays. Used to be ironclad, but now just come up with a good excuse and its gone. She felt pressured? She didn't know what she was signing? Bullshit. She knew exactly what she was signing. But now she wants to change the rules of the game once things turned out not to be in her favor.
