If you have signage at your entryway saying something to the effect of "This property is under video surveillance", maybe next to an ADT sign, you are in a gray area recording sex in a common area like a living room, but likely wouldn't need explicit consent -

I too would be interested in learning more about this. My computer sits on my desk directly opposite my bed (I have it plugged into my TV and speaker system).
Ideally I'd have everything set up beforehand, so when I bring her into the bedroom, as I turn on the music, I can also subtly start recording using the computer's built-in webcam, without pop ups or noise or anything alerting her to the fact that I just started recording.

Im certain that the fact that he "threatened" to post the video had as much or more to do with the sentence than did the actual recording. He was a douchebag or at least a moron trying to effect some type of cyber threat on the girl (article doesn't tell the whole story)
If, hypothetically, let's say he never told anyone or otherwise shared the existence of the video She later levels some false rape charge against him and the video did show "enthusiastic consent" on her part, that he only disclosed to aid in his defense I bet the outcome would have been different.
Worst case I'd rather be facing "illegal surveillance" charges than rape charges...but that's just me

Funny how I have never been accused of raping a girl I actually had sex with. The one time it did happen she just told people in a small outer social circle of mine and nobody, male or female, believed her for a second. Perform well and dont get falsely accused. Without that recording, it's your word against hers. (I believe) 40-something states are one-party recording states, the rest are all-party recording states.
Regardless, even if I was in an 'all party' state, I'd rather be staring down the recording charge, instead of a false rape or DV charge.

It's worth doing some research before buying a camera. Some have big bright lights to indicate when they're recording, but have hidden settings to disable them. Then you can just have your webcam in plain sight and it looks like it's off.

Don't overcomplicate it. You can do something as simple as:
A) Stuff a camera into a toy or stuffed animal and stream the video to your phone. Like this:
B) Download [/video]a [/video]Securith=y Monitor or Baby Monitor app on to an ol[/video]d cell phone and you wont even have to hide it, just leave it on the dresser with the camera facing the bed. Like These:

If you've got to do this then your best bet is to make a false smoke alarm. That way you can have the little red light to indicate it's recording but nobody is going to pay attention to it. It also allows you to duplicate the same setup for every room rather than having to come up with something new each time.
Just don't be an ass and keep glancing at it or you might tip them off.

The smoke alarm cameras are available online, as well as clock cameras, both wall and nightstand.
If you wanna get down, dirty, and creative, Harbor Freight has a two camera system that not only has it's own monitor, but comes with a cord that can be run to a VCR or DVR system.
The cameras are small enough to be mounted and hidden in a myriad of different places, especially if you remove the mounting bracket.
I actually looked into and purchased this particular system before getting the 8 camera DVR system for my home. The quality of the cameras was pretty good, it just didn't suit my needs, I needed it to monitor my home/property.
The key is to place the camera(s) somewhere that doesn't draw attention.
- I've got a ceramic skull on my dresser that (if I could get the camera into the skull) would be perfect. I'd mount the camera so the lens looks through the eye.
- Do you have a sound bar above or below your TV ? If there's some empty space in the sound bar's cabinet, a small hole with the camera mounted inside the bar wouldn't draw any attention.
- Is there a return vent in the ceiling or high up on the wall ? A camera can be mounted there.
- A lamp with a large base could make a good spot for mounting a camera.
- Depending on the layout of your place, you could modify one of these:
The bottom line is if you're going to make your own hidden camera, you need to get creative.

Its for home security. Could probably be grounds for plausible deniability since you are using it as a way to monitor your belongings. On the free plan it saves video clips when triggered for 36 hours on the cloud then deletes. I'm not saying you should use it for these things, but it can be and you have a built in excuse.

Since there's some back-and-forth about this, I'll point out that in many American states, creating video showing sex acts or nudity in a private place without consent, even it's a guest stripping down in your own bedroom, is still unlawful surveillance.
So, supposing you're the subject of a false rape accusation, you've now got exculpatory evidence that will never be shown to the jury since it was gathered illegally but that is also evidence of a separate felony and might be construed as revenge porn if you try to show it to the media to try to save your reputation.
You're probably better off with a properly documented audio recording of her screaming her consent. If your security system also captures people entering/leaving your home to provide a record of who was screaming it, all the better.

Keep a framed copy of this in view of the camera. Most girls wont even ask in the heat of the moment but the ones that do think it is a joke or novelty.
If the tape is truly exculpatory most DA's arent going to want to prosecute charges hoping to get the tape excluded at trial
As long your not disseminating the recordings afterwards the likelihood of you getting charged with privacy violations are really low to nil. In any event Id take a "tortious intrusion" charge over sexual assault or rape charge any day.
