Funny you say this because the irony is that if Winston had recorded it he would have surely been found guilty of violating Code of Conduct and been suspended. In fact, the only one who has ever been punished for the events of that night was his roommate and teammate Chris Casher for admitting to this very thing (he had since lost the phone and the video was never found):

By making videotaping a sexual encounter "illegal", it's almost as if universities do not want to allow any exculpatory evidence to be available.
